Terms & Conditions

General Working Agreement

 

The information provided here defines the terms and conditions of our working relationship. 

All projects or services that Creative Freelance by Sarah-Hayley Owen may be contracted to produce or provide

will be subject to the following:

 

1. Payment

All services are paid online.  Where an outstanding amount is required, the client will be invoiced.

All invoices are payable within 14 business days of receipt. A $50 service charge is payable on all overdue balances for reissuing each invoice every 21 days from the date of original invoice. The grant of any license or right of copyright is conditioned on receipt of full payment.

 

2. Default in payment

The Client listed in the invoice shall assume responsibility for cost outlays by Creative Freelance by Sarah-Hayley Owen in all collections of unpaid fees and of legal fees necessitated by default in payment. Invoices in default will include but are not limited to fees for collection and legal costs.

 

3. Cancellation

Any cancellations for services required must be made 72 hours after booking. In the event of cancellation of assignments, ownership of all copyrights and the original work shall be retained by Creative Freelance by Sarah-Hayley Owen and a cancellation fee for work completed, shall be paid by the Client. Cancellation fee is based on 35% of original price. If cancelled once project has been signed

off, the client will be invoiced for the cancellation fee, plus a flat fee of $250.

On the event of Sarah-Hayley Owen cancelling a project, the price in full will be refunded.

 

4. Errors and Omissions

It is the Client's responsibility to check proofs carefully for accuracy in all respects. Creative Freelance by Sarah-Hayley Owen is not liable for errors or omissions. The Client's signature or an authorized representative is required

on all release forms prior completion.

 

5. The Client's Role

The client agrees to provide Creative Freelance by Sarah-Hayley Owen with everything required to complete the

project including product details and access to product images.

The client agrees to review the project when required, provide feedback and sign-off approval in a

timely manner.

 

 

How to Pay

 

By card: We accept all major payment cards and payment via PayPal.

 

Payment Plan - If you would prefer to pay for your service via payment plan and invoices, we require a 35% advance deposit payment to confirm booking.

 

By check: Please make check payable to Sarah-Hayley Owen, with your address, check

guarantee number, expiry date and issue number (Switch only) on the back.    



 
Availability

 

On occasion if my diary is fully booked I will be unable to commit to a project.  If you have paid in advance you will be refunded.  Please read the information on each service in order to correctly order services in a timely manor for your own deadline. We will advise you if there is any problem with your order.

1.4 We will not, without your consent, use your personal information to:

(a) supply your personal information to any third party for the purpose of their or any other third party's direct marketing.

 

2. Financial Privacy

All our website financial transactions are handled through our payment services provider, 'stripe'. You can review the provider's privacy policy at [https://stripe.com/gb/privacy]. We will share information with our payment services provider only to the extent necessary for the purposes of processing payments you make via our website, refunding such payments and dealing with complaints and queries relating to such payments and refunds.

 

3. Disclosing personal information

We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents or suppliers insofar as reasonably necessary for the purposes set out in this policy.

 

3.1 We may disclose your personal information: 

(a) to the extent that we are required to do so by law;

(c) in order to establish, exercise or defend our legal rights, including providing information to others for the purposes of fraud prevention and reducing credit risk;

 

4. Your rights

You may instruct us to provide you with any personal information we hold about you; provision of such information will be subject to: 

(a) the payment of a fee (currently fixed at USD 10); and

(b) the supply of appropriate evidence of your identity (for this purpose, we will usually accept a photocopy of your passport certified by a solicitor or bank plus an original copy of a utility bill showing your current address)

 

5. Third party websites

Our website includes hyperlinks to, and details of, third party websites.

 

5.1 We have no control over, and are not responsible for, the privacy policies and practices of third parties.

 

6. Updating information
